Mediation is being heavily promoted by Indian courts now a days. For NRIs it is a boon. You can avoid years of litigation by taking this simple route. You just need to adjust your expectations and can avoid unnecessary trips to India for hearings. The Mediation and Conciliation Project Committe (MCPC) was setup in the year 2005 by Hon. Supreme Court. This provided an easy way to amicably resolve disputes in accordance with Section 89 of the Code of Civil Procedure. It is a volunrary but binding process i.e., any resolution that is agreed upon is legally binding and no party can later disagree to it.
